Car & Bike Show Event Rules and Release of Liability Terms

NOMENCLATURE:

The Midnight Sun Festival Car & Bike Show, hereinafter “Event”, is organized by Midnight Sun Festival, Inc., hereinafter “Organizer”. The Officers and volunteers of Organizer, hereinafter “Management”. The Car & Bike Show – Event Rules, hereinafter “Event Rules”. The Event participant and his/her accompanying personnel, hereinafter “Participants”.

EVENT LOCATION & HOURS:

Bryant Park, Lake Worth Beach, Florida. Saturday, Mar. 2, 2024 – 1:00 to 5:00 pm.

REGISTRATION:

Registration for vehicles is FREE!

SET-UP:

Event set-up will be 11:00 am – 12:30 pm on Saturday, March 2, 2024. Enter Bryant Park from the Lake Avenue gate. Participants must check-in with Management prior to setup, to be assigned a space. Vehicles will be parked on the open-air lawn at Bryant Park. Set-up must be completed by 12:30 pm.

REMOVAL OF VEHICLES:

Vehicles can be removed from Bryant Park on Saturday, Mar. 2, 2024, between 5:00 pm – 7:00 pm. Early removal of vehicles is disruptive and not permitted. Participants agree to leave their space in the same condition as prior to the Event.

INDEPENDENT CONTRACTOR:

Participants agree they are an independent contractor and not employed or hired by Organizer.

MOVEMENT OF VEHICLES:

For safety reasons, no vehicles may be moved in Bryant Park during Event Hours unless approved in writing by Management. In the case of an emergency, Participants shall request permission from Management.

TROPHIES:

Midnight Sun Festival attendees will be given a voting ticket with each paid admission. Winners will receive trophies.

FOOD, BEVERAGES, MERCHANDISE, SMOKING, ALCOHOL:

Please support the Midnight Sun Festival Vendors and purchase food, beer, wine, and other beverages from them!

Participants agree not to bring in food, beer, wine, soft drinks, etc. Sale of merchandise without Management’s written permission is not permitted. Participants agree to abide by Event Rules and conduct themselves in a polite manner. No smoking except in designated smoking areas. Alcohol consumption is permitted during the Event but not to excess. Management shall determine what constitutes appropriate behavior.

PROMOTIONAL MATERIALS:

Participants agree that the Organizer may use photographs, audio/video recordings and/or information about Participants and/orParticipants’ vehicle(s), for promotion of the Event, future events, or other purposes.

INSURANCE/ LIABILITY:

The Organizer is not responsible for any personal injury, accident, property damage, or lost or stolen property that may occur at the Event. Participants assume all liability for any loss or costs that Participants may incur. Insurance coverage for Participants is not provided by the Organizer.

WAIVER & RELEASE:

The Organizer and Management shall not be responsible for any property damages or personal injury resulting from any cause related to the Event. Participants hereby forever release, waive and hold harmless the Organizer and Management from any liability for any damage to person or property, including but not limited to, injury, disability, death, property damage or theft, loss of income, or any other losses or costs of any kind sustained by Participants arising out of Participants’ involvement in the Event.

INDEMNIFICATION:

Participants hereby indemnify and hold harmless the Organizer, Management, and other Event participants from any liability, claim or suit, which may be asserted by reason of any property damage, injury or death caused by Participants’ vehicle or which occurs as a result of Participants’ negligent or wrongful conduct during the Event. Such indemnification shall include costs and reasonable attorney’s fees.

GOVERNING LAW

Any dispute shall be governed by the laws of the State of Florida. Venue shall be Palm Beach County, Florida.
